This Personal Data Processing Policy (hereinafter referred to as the "Policy") is prepared by the Site Administration in accordance with the provisions and requirements of the current legislation and aims to define the terms regarding the receipt (collection) of information about Site Users, the use and transfer of information about Site Users, and the provision of access to information about Site Users to third parties, in particular to Credit Organizations.
This Policy is a legally binding document for Users who use the Site for its intended purpose. Each User is obliged to familiarize themselves with this Policy before starting to use the Site.
Acceptance of this Policy is made when the User performs actions indicating that they have read and accepted the Policy, namely by actually using the Site (its technical capabilities and functionality), which indicates the User's intention, will, desire, and consent to observe and comply with this Policy.
Acceptance of the Policy means familiarization with, understanding of all terms of the Policy collectively and individually, the User's full, unconditional, and unequivocal agreement with its provisions and requirements, and the undertaking of an obligation to strictly comply with all rules defined in the Policy.
The Site Administration and the User are hereinafter jointly referred to as the "Parties," and individually as a "Party."
1.1. For the purposes of this Policy, the following terms are used with the meanings indicated below:
1.1.1. Site – a result of intellectual activity, being a composite work located on the Internet under a specific network address (domain, domain name, subdomain) and including computer programs (software) ensuring its technological and technical functioning, graphic design (design, layout of elements, color scheme, etc.), content, namely textual information, photographic images, pictures, video recordings, audio recordings, etc., united by a common purpose and meaning and presented as web pages. The "Site" in the text of this Agreement refers to the Site owned by the Site Administration, located on the Internet under the domain name (domain, subdomain, address) – https://buildband.pro/, as well as its constituent subdomains and derivative web pages.
1.1.2. Site Administration – the owner of this website, who has the rights to use, manage, and dispose of the Site, provides the Site for use to Users, and provides Users with the services stipulated by the User Agreement, described directly on the Site or determined by the Site's technical functionality. An authorized representative (moderator) appointed directly by the Site Administration acts on behalf of the Site Administration on the Site.
1.1.3. User – a natural person who is a recipient or potential recipient of services provided by the Site Administration, described directly on the Site or determined by the Site's technical functionality.
1.1.4. Information (data) – any information about or relating to a User.
1.1.5. Personal Data — any information relating to a directly or indirectly identified or identifiable natural person (subject of personal data).
1.1.6. Processing of Personal Data — any action (operation) or set of actions (operations) performed with personal data, with or without automation, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), retrieval, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.
1.1.7. Request (application, inquiry) – an appeal by a User through forms on the Site for the purpose of obtaining legal advice, an answer to a question, or other information and/or concluding an agreement for the provision of legal services for bankruptcy support for individuals.
1.2. In case of ambiguity in the interpretation of a term in this Policy, interpretation should be guided first by the definitions on the Site https://buildband.pro/ (hereinafter referred to as the "Site"); second, in accordance with the norms of the current legislation.
2.1. This Policy aims to ensure proper protection of Information about Users, including their personal data, from unauthorized access by third parties, and to define the procedure for obtaining, providing, and using Information about Users.
2.2. This Policy is intended to define only general provisions regarding the receipt and use of Information about Users. Specific features of obtaining and using Information may be established by other documents published on the Site or may be determined by the Site's technical structure.
3.1. The list of Information provided by the User and posted on the Site is established solely at the discretion of the Site Administration.
3.2. The User agrees to post and provide their personal data for the purpose of the Site Administration fulfilling its obligations to the User for the provision of services stipulated by the User Agreement, described directly on the Site or determined by its technical functionality.
3.3. Posting personal data on the Site by the User pursues the goal of receiving services from the Site Administration in accordance with their purpose and focus.
3.4. The use of Information about a User for any purposes other than those corresponding to the Site's subject matter is unacceptable.
3.5. The User has the right to delete personal information, as well as any other information posted by them on the Site. For this, the User must contact the Site Administration via email with a request to delete or modify the User's personal data.
3.6. By using the Site, the User agrees and accepts that the Site Administration reserves the right to use their personal data anonymously and in an aggregated form for statistical purposes.
3.7. The Site Administration undertakes not to provide any personal data about Users to private individuals and organizations that declare possible misuse of such information (sending unsolicited advertising, spam, providing information to other persons, etc.).
3.8. The Site Administration is not responsible for possible misuse of information posted on the Site by Users or other persons, which occurred without notifying the Site Administration, with or without a breach of the Site's information security.
3.9. The Site Administration processes only those personal data of Users that have been posted on the Site. Personal data of Users is processed using the Site's software, hardware, and technical means.
4.1. The Site Administration obtains information about Users in the following ways (from the following sources):
4.1.1. Information provided directly by the Users themselves, including, but not limited to:
4.1.1.1. The Site Administration has the right, at its discretion, to request or require the User to specify any Information necessary for it to fulfill its obligations to Users. The User is hereby obliged to provide exclusively reliable, complete, and up-to-date information about themselves.
4.1.2. Information from software, technical, and hardware services (software, etc.) used by the User when viewing the Site's web pages, including, but not limited to:

The User hereby acknowledges and agrees that posting their information on the Site, as well as transferring it to the Site Administration, including their personal data, is done independently, voluntarily, and at their own discretion. By posting their personal data on the Site, the User confirms that they are doing so voluntarily and that they voluntarily provide it to the Site Administration for processing.
5.2. The User hereby gives consent to the processing of their personal data in accordance with the provisions of the current legislation. The Site Administration has the right to use the User's personal data for the purpose of fulfilling its obligations to the User, including those specified in Section 3 of this Policy, in accordance with the terms of the current legislation on personal data.
5.3. The User hereby gives consent to receive from the Site Administration various SMS mailings, e-mails, and other forms of sending/receiving information, including advertising content.
5.4. The Site Administration does not verify the accuracy of Information provided by or received from Users and does not control their legal capacity and capacity. It is presumed and the Site Administration proceeds from the assumption that the User in all cases provides complete and reliable information about themselves and keeps this information up to date.
5.5. The Site Administration, when processing personal data of Users, undertakes to take all organizational and technical measures to protect it from unauthorized access in a manner not provided for by the Site. However, it is possible that as a result of a Site malfunction, virus or hacker attack, technical failures, or other circumstances, personal data of Users may become available to other persons.
5.6. The Site Administration undertakes not to post on the Site personal data of other persons, nor to use personal data of other Users in any manner inconsistent with the requirements of the legislation, for unlawful or illegal purposes, for profit, or any other purposes inconsistent with the purposes of the Site.
6.1. The Site Administration is not entitled, except for the cases specified in clause 6.2. of this Policy, to transfer Information about a User to third parties, either for a fee or free of charge, without the User's consent.
6.2. The Site Administration has the right to transfer information about a User without their consent and without prior notice in the following cases:
7.1. The Site Administration and the User hereby establish a pre-trial claim procedure for settling disagreements and disputes arising from the application of this Policy. The period for responding to a submitted claim is 10 (ten) working days from the moment of its receipt.
7.2. If no agreement is reached on contentious issues, a dispute arising from this Policy shall be subject to judicial consideration in accordance with the current legislation at the location of the Site Administration.
8.1. This Policy comes into force from the moment it is posted on the Internet on the Site specified in clause 1.1.1. of this Policy.
8.2. This Policy is introduced for an indefinite period and loses its force upon its annulment by the Site Administration.
8.3. In case of amendments to the Policy, such amendments enter into force from the moment the new version of the Policy is published on the Site, unless a different effective date for the amendments is specified upon its publication. The Site Administration has the right to make amendments to the text of the Policy unilaterally.
8.4. The User undertakes to independently monitor changes to the provisions of this Policy and bears responsibility and negative consequences associated with non-compliance with this obligation.
8.5. If the User disagrees with the relevant changes, the User must stop using the Site and refuse the services provided by the Site Administration. Otherwise, continued use of the Site by the User means that the User agrees with the terms of the Policy in the new version.
8.6. The current version of the Policy is located on the Site at: https://buildband.pro/privacy-policy.html. In case of any inconsistencies between the version of the Policy drawn up in Russian and the version of the Policy translated into another language, the provisions of the Policy drawn up in Russian shall have priority and direct application.
